WELCOME sudin care Ltd (”Company”, ”we, ”our”,”us”) team of certified health care professionals and attendants specializing in providing professional health services at home. These services Terms & Conditions represent a public Offer by sudin care started on Aug 2024 under the laws of Nepal Government  registered at the address: Anamnagar 29, kathmandu Nepal. sudin care,amongst other services, facilitates in finding and comparing prospective doctors and health care providers in identified locations (“service”) and this service is provided only in good faith. The Company offers any individual (the “Patient”,you) to enter into a contract for the provision of medical services (the “Services”) in accordance with the terms and conditions. The services of sudin care are essentially provided to bridge the information gap between patients and doctors. These Terms apply to all visitors, users and others who wish to access or use Service.

We request you to carefully go through these terms of use (“Terms of Use”) before you decide to the services of Sudin care by registering with the company, you accept all the obligations stipulated in these terms of use and agree to them. Accessing the website through any medium, including but not limited to mobile phones, smart phones and tablets, are also subjected to use supersede all previous oral and written.

By using this website, you signify your agreement to these Terms of Use as well as the website’s www.sudincare.We reserve the right to modify or terminate any portion of the website or the services offered by the company for any reason, without notice and without liability to you or any third party. To make sure you are aware of any changes, please review these terms of use periodically. These Terms apply to all visitors, users and others who wish to access or use Service. The website should not be used in cases of medical emergencies and should not be considered in any form to be a substitute for a doctor or a hospital.

Personal data processing: The company will process the Patient’s personal data, including special categories of personal data, in relation to this Agreement and the Services provided. The Patient must carefully read Patient Privacy Notice and Consent Form, available on the Company’s website. This should be read in conjunction with the Company’s full Privacy Policy, available on the Company’s website.

Confidentiality and Data Protection

  • Client information will be kept confidential and used only for service provision.
  • Personal data will not be shared without client consent, except as required by law.
  • Company guarantee to the patient protection of the Patient’s confidential information

and non-disclosure of medical information unless required by law, safeguarding or other

legal reasons.

The Company:

Provide the Patient with free, accessible, reliable information about the services of company.

Inform the Patient if the services require the provision of additional medical services not provided for by the Agreement.

Ensure quality of the services to be provided to the Patient in accordance with the Company’s working hours,list of medical services,requirements for diagnostic methods, prevention and treatment permitted.

If any obstacles to the fulfilment of the terms of this Agreement occur, the Company shall immediately notify the Patient of such circumstances.

In the course of providing the services, inform the patient or the Patient’s legal representative about the upcoming basic or additional therapeutic and other procedures and their costs, necessary medications and consumables and their costs.

Provide the Patient with complete and understandable information about the goals, methods of medical care, associated risks, possible options for medical intervention.

The anticipated results of medical care or alternatives and consequences of refusing medical care and signing of the forms of informed consent or medical treatment and services refusal.

If required, at the expense of the Patient necessary examinations in other medical institutions that will deliver the services required. By signing this Agreement, the Patient confirms the Patient’s consent to the arrangement of such examinations.

Keep medical record documents, provide the Patient with medical documents in the prescribed form including the physician’s report and results of the examination.

The physician who conducts a study shall notify the Patient of the approximate date of receipt and examination results.Keep records of the type, scope and quality of medical care provided. Patient’s interests should other providers of medical services be involved, and provide.

Provide complete and accurate information about the personnel delivering the services, details of the services to be provided and possible associated risks or such other potential complications.

In the Patient’s best interest the Company may contact with the Patient’s General Practitioner or family doctor or other treating doctor of the Patient’s choice to ensure a seamless exchange of medical information.

However, the Patient has the right to refuse the exchange of such information with their General Practitioner or family doctor or other treating doctor of the Patient’s choice.

The Company has the right to:

Set the time, place and conditions for the Services’s provision and define specific performers of such Services.

Suspend delivery of the services and issuance of medical documentation to the Patient in case of delay in payment until the full performance of the Patient’s obligation.

In the case of emergency conditions, independently determine the scope of medical care (examinations,  manipulations, surgical interventions required to provide medical care) without the Patient’s written consent.

Reserves the right to modify the terms of this Agreement in accordance with applicable laws. If we make material changes to the Terms, we will notify you via email, or other means, to provide you an opportunity to review the changes before they become effective.

Refuse to perform this Agreement if the Patient fails to comply with the Company’s working hours and requirements, as well as recommendations of a physician and/or medical staff of the Company.

Demand compensation for losses from the Patient in case of damage to the property of the Company.

Equal Opportunities:

The Company operates an equal opportunities policy and makes no discrimination on the basis of age(18 above), race, religion, gender, sexual orientation, marital status or disability

 

Payment and Fees

  • Fees are based on the type and duration of services provided.
  • Payments must be made as per the agreement billing cycle (weekly/monthly).
  • Late payments may additional charges.
  • Additional services requested beyond the care plan may be billed separately

Cancellation and Refund Policy

  • Clients must provide at least pre inform notice for service cancellation.
  • Cancellations made without prior notice may be charged a cancellation fee.
  • Refunds will be processed within some days.
  • The Provider reserves the right to terminate services if there is abuse, non-payment,or unsafe condition.

Liability and Insurance

  • The Provider shall not be held liable for injuries, accidents, or unforeseen incidents
  • occurring at the client’s home unless due to proven negligence.
  • Clients are advised to have appropriate insurance coverage for in-home care services.
  • Self-employed persons are responsible to pay their own pay roll tax, social insurance pension and health insurance.
  • The Company takes all reasonable steps, in line with company standards,to investigate and

verify  the standards of skill, care, integrity and reliability of the Care Workers .

  • Other facilities and benifits will be applicable as per company policies.

Breakages and damages in Customer’s homes

The Company will not accept any liability for any damage (whether direct or indirect) done by the Care Worker to any goods, equipment or fixtures and fittings in the Customer’s property and accepts no responsibility for wear and tear fixtures and fittings in the Customers property.

Customers possessions are not covered by the Companys insurance policy, and should therefore be covered by their own household or other insurance. It is the Customers responsibility to ensure that the household insurance policy covers the Customer for having a Care Worker in the Customer’s property (whether as live-in care or under hourly-care).

Termination of the agreement.

The present Agreement comes into effect upon its acceptance and is valid until the obligations by the parties have been performed in full.

This Agreement can be terminated early upon agreement of the parties, with there imbursement of funds by the Company within 60 days of termination for and medical Service, which for one reason or another was not actually provided to the Patient. Where a Service has been provided in part by the Company, only a partial refund shall be provided representing the Service yet to be performed.

The Agreement may be terminated due to force majeure circumstances that make it impossible for the Patient and the Company to continue the performance of the Agreement.

Governing Law:

These terms and conditions shall be governed by the laws of Nepal.

In an effort to protect the rights of copyright owners, company maintains a policy for the termination, in appropriate circumstances, of Registered Users and other users of this Site who are repeat infringers.
